The national prosecutor, Jorge Abbott, sent an instruction to regional prosecutors and the head of the Unit for Crimes against Organized Crime, Mauricio Fernández, on how the Public Ministry will act in the face of possible health crimes during this Sunday’s plebiscite.

Abbott told prosecutors that people infected with covid-19 who go to vote will be criminally prosecuted, because due to health regulations they are prohibited from going to the polling stations, according to the daily La Tercera.

“In our opinion, restrictions on the right to vote are legitimate in the context of a health emergency such as the one experienced and to that extent, a Covid patient will not be able to successfully use, in his defense, a cause of justification in relation to their conduct in violation of a sanitary isolation order, under the pretext of being legitimately exercising a right ”, Abbott stated in an email.

In the letter, Abbott raises a confrontation between fundamental rights, between the right to vote and the right to health of people, positioning himself for the second instance.

“The exercise of the right to vote by a single infected person constitutes an ideal behavior to put the health and even the lives of many people at risk,
enabling the generation of a chain of infections, “he adds.

The Government and the Servel announced measures to carry out random controls and prevent people infected with covid-19 from entering the polling stations.
