Judge Leonardo Enrique Valdivieso Lobos, of the Eighth Guarantee Court of Santiago, decided to declare as inadmissible the complaint filed against the Defender for Children, Patricia Muñoz by the State’s Internal Security Law.
The ruling was published by former prosecutor Carlos Gajardo. And among the arguments to be declared inadmissible, it is mentioned that “investigations of the facts constituting the crimes described and punished (…) may only be initiated by a complaint or complaint from the Ministry of the Interior, the respective regional mayor or the authority o affected person “.
“Consequently,” adds the resolution, “it is incontrovertible that the actor lacks standing, lacks active standing to exercise this criminal action, since he does not hold any of the magistrates described there, nor is he the person affected.”
The libel was filed by Magellan lawyer Mario Esquivel Lizondo, recognized in southern Chile for his marked right-wing tendency, as a result of the controversial campaign by the Children’s Ombudsman in commemoration of the 30th anniversary of Chile’s ratification of the Convention of the Rights of the Child, which included a song whose lyrics invited young people to “skip all the turnstiles.”
In this regard, the lawyer Carlos Gajardo commented on his Twitter account: “Court declares inadmissible complaint against Defender of Children by law of internal security of the State. It can only be filed by the executive. He put a 1 on that lawyer. To study law again for ignorant “.
