The La Ligua Guarantee Court, in the Valparaíso region, accepted a complaint filed by a private lawyer against the President of the Republic, Sebastián Piñera, for not wearing a mask during a walk on the beach.
Specifically, the lawyer Luis Rendon Escobar The legal action was filed after a selfie-type photograph that the President took with a young woman became viral, events that would have occurred last Saturday on the Cachagua beach.
The situation unleashed a wave of criticism on social networks and the President himself decided to report himself to the respective health authority for failure to comply with the preventive measure for the coronavirus.
This Sunday, meanwhile, the lawyer filed a criminal complaint, accusing the Head of State of violating article 318 of the Penal Code, which establishes sanctions for those who put public health at risk.
The writing was admitted for processing by the La Ligua court and consequently, the antecedents were sent to the Public Ministry.
The jurist valued the decision and remarked that “because it was a crime it had to be investigated in legal headquarters by the Public ministry and then sanctioned by the courts ”.
“It could not be that this was investigated by a purely administrative instance such as the Seremi de Salud that reports directly to President Piñera,” Rendón added.
Prosecutor evaluates investigating
For its part, from the La Ligua Local Prosecutor’s Office they issued a public statement where they assure that they have already received the complaint presented to the guarantee court.
“The Prosecutor’s Office will evaluate the facts denounced and the measures requested, taking into consideration the current criteria, according to which it is possible to dismiss the prosecution of the violation of the obligation to wear a mask in certain places,” they indicate.
Specific, it is not certain that a criminal prosecution will be initiated against the highest authority in the country, which will be subject to evaluation and will be informed when appropriate.
