Ricardo Rincón’s hats: From deputy to lobbyist for Felices y Forrados, and his efforts to become governor

In the space -which managed to capture the attention of 2,700 spectators today- the former parliamentarian, who was expelled by the Christian Democrats after a complaint of domestic violence, he went all out against the government’s plan to block the withdrawal of 10% of the pension funds through a presentation before the Constitutional Court.

In his opinion, the legislative initiatives that point to new withdrawals of pension funds will continue to take place, then -he said- “It is not only money that goes to help the needs of people, it is also a clear sign of questioning the AFP system, which is illegitimate and must be eliminated”. In effect, like his sister, Senator Ximena Rincón, the former parliamentarian is an active detractor of the individually funded system and a promoter of pension savings withdrawals. Since June of this year, he has even maintained the website www.nuestrosfondos.cl, which is registered in his name.

“I think (Sebastián) Piñera is more concerned about the interests of the AFPs and their controllers and those who benefit from the stock deals. Even he himself is being publicly accused of doing triangulations prohibited by Chilean pension law. It is about triangulations and they seek with the money from savers to buy the shares of the AFPs themselves ”, warned Rincón.

The accusation referred to by the parliamentarian is linked to the Public complaint that the founder of Felices y Forrados, Gino Lorenzini, has made against President Sebastián Piñera since November last year on an eventual violation of articles 45 bis and 47 bis of Decree Law 3,500 of 1980, by AFP Habitat due to its investments in funds managed by AGF Moneda Asset. However, -last Thursday- the Superintendency of Pensions (SP) reported that this situation was investigated in a timely manner last year, in compliance with the provisions and powers conferred by law, reaching the conclusion that said investments comply with current regulations.

In 2015, a group of deputies from the Christian Democracy, including Rincón, Fuad Chahin and Marcelo Chávez, filed a complaint for prevarication against the superintendent of Pensions, Tamara Agnic, for the controversial merger between the AFP Cuprum and Argentum.

The onslaught of the parliamentarians against the operation that allowed Principal Financial Group to obtain a tax goodwill for $ 80,000 million was celebrated and supported by FyF. The libel accused the regulator of committing a crime by giving the green light to the transaction, knowing that the underlying objective was a reduction in taxes for the operation.

But the contacts between FyF and Rincón have been permanent, and after the context of constitutional change and reform of the pension system they have been accentuated.

Last October 26, in the midst of the parliamentary discussion that seeks on the one hand to stop the withdrawal of pension funds and, at the same time, establish more regulations for the administration of said resources, representatives of FyF and the Central Bank held a face-to-face meeting through the Lobby Law.

The regulator explained that the request for a hearing was made by Gino Lorenzini, Ricardo Ricardo Rincón and Carlos Díaz, general manager of FyF. Diaz, Alejandro Almonte, finance manager, and Santiago Ibáñez, from the Eluchans law firm attended this meeting. While the Central Bank was attended by the lawyer and Regulatory Chief, Pablo Mattar, and the economist of the Infrastructure and Financial Regulation management, Fernando Sepúlveda.

The Central Bank explained that the meeting was not published in the Lobby Law system because it was not carried out by a taxpayer. The meeting was framed within the discussion about the changes that the regulator seeks to introduce to market agents.

On October 4, 2019, the former deputy Rincón appears in the official register of the Commission for the Financial Market (CMF), as a representative of Happy and Loaded SpA, another of the companies linked to the founder of FyF. On that occasion, the reason for the hearing was to talk with the Head of the Regulator’s Legal Area, José Antonio Gaspar, on a reserved complaint.

The meeting was attended by Gino Lorenzini and Alejandro Almonte, Finance Manager of the platform.

In parallel to his advisory efforts to Felices y Forrados, Rincón has made every effort to be candidate for governor of the O’Higgins Region. Over the past four weeks, he has sought intensively to gather signatures, questioning the process because of the restrictions that the system places on independent candidates.

I personally started this process almost a month ago and it is a very difficult process. Yesterday, in a tweet the deputy and head of the bank DC Gabriel Ascencio He announced that he would meet with Gino Lorenzini to find out information about the complaint for possible triangulation of money in the alleged purchase of shares in AFP Habitat. “I don’t know where this invitation comes from. We were not informed. I saw it on the bank account and it seems like an inappropriate and untimely meeting. He is a very controversial person (Gino Lorenzini) and the members of the bench are free to meet with whoever they want. I’m not going to participate in that meeting And it seems to me that it does not contribute to the profile of our party before society, but it is my opinion. The founder of FyF has had previous contacts with the DC. On April 13, 2018, Fuad chahin -today president of the DC- accompanied Gino Lorenzini as interest manager to a meeting, requested through the platform of Lobby Law, with the then Undersecretary of Social Security, María José Zaldívar (today Minister of Labor). The objective? Present to the authority a series of proposals to improve the current pension system of Felices y Forrados SpA.

There is no weight of Happy and Lined in DC. Felices y Forrados has no ties to DC of any kind. Ricardo Rincón has not been a member of the Christian Democracy for a long time and I simply met Gino Lorenzini in the framework of the investigative commission of the merger between AFP Cuprum and Argentum, and on the appointed date, I managed to get a meeting with the then former undersecretary, where I delivered a proposal to reform the pension system, ”Chahin explained to La Tercera PM.
