The Social Security Institute (IPS) pointed out that said amount will be paid in December “to all pension beneficiaries who meet the requirements established in the law that is issued each year.”
This 2020 will be $ 23,081 basis to deliver to each person who meets the requirements, a figure that is not affected by any type of discount.
That amount “will increase by $ 13,040 for each person that, as of November 30, 2020, the pensioner has accredited as a family burden,” said Chile Atiende.
Who is entitled to the Christmas bonus?
According to information from the IPS, pensioners from the Dipreca and Capredena Social Security Funds, the Labor Safety Institute, the Employers’ Mutual Benefit Societies of the Law 16,744 on Work Injuries have the right to have any of these qualities as of November 30 of the current year.
In the case of the IPS, the beneficiaries are the following:
-Pensioned from the former Provident Banks.
-People with Basic Solidarity Pension (PBS).
-Pensionados with Solidarity Pension Contribution (APS), of the AFP System.
-Pensioned of Law N ° 19,234 (Political Exempt).
-Pensioned of the Reparation Law N ° 19,123 (Rettig Law).
-Pensioned of the Law of Reparation N ° 19,992 (Valech Law).
-Pensionados of Work Accidents, Law N ° 16,744, of the Institute of Labor Safety (ISL).
-People who receive Subsidy for Mental Disability, Art. 35 of Law No. 20,255.
-Recipients of compensation from Coal, Law No. 19,129.
The people who will benefit will have the right to a single bonus, even if they are beneficiaries of two or more pensions.
What if I am a pensioner through the AFP system?
Pensioners from AFPs and insurance companies (DL 3,500) are entitled “provided that as of November 30 of the current year receive minimum pensions with a State Guarantee or are receiving the benefit of the Solidarity Pension Contribution (better known as APS, and which consists of a monthly amount provided by the State to supplement the lower pensions) ”, indicated the IPS.
The payment must be made by the pension entity in charge of delivering the monthly pension.
How and when will I receive the bonus?
The Christmas bonus payment is included in the monthly pension. Therefore, pensioners should not do any additional procedure to receive this financial aid provided by the State.
Public workers
By law, contract and permanent public sector employees receive – depending on their salary – a bonus that fluctuates between $ 30,000 and $ 60,000, approximately.
The State is obliged by statute to deliver said money to them in their December remuneration.
Private sector workers
In the private sector, the scenario is completely different: the employer has no legal obligation to deliver a Christmas bonus to his collaborators.
“In our country, the delivery of bonuses operates according to the agreement of the parties, that is, between the worker and the employer, since it is not a legal norm. This bonus is granted to workers of companies that have it contemplated in their collective contract ”, mentioned the Labor Directorate on its website.
But when is the Christmas bonus considered as an acquired right in the private sector ?: if the bonus has been given to the workers of a company before, systematically, its delivery for the following years operates as tacit clause. That is, it is understood as an acquired right.
For example, if an employer delivers a bonus for 3 or 4 years in a row and cannot do so on the fifth year, the unions may claim this right before the labor courts.
