Government asked the TC to declare unconstitutional the second withdrawal of 10 percent

The Government entered this Sunday a request before the Constitutional Court (TC) to declare unconstitutional the parliamentary bill for a second withdrawal of 10 percent of pension funds.

This announcement comes after Tuesday the Minister of the Segpres, Christian Monckeberg, announce “a reservation of constitutionality” to the project, after it was approved by the Senate Constitution Committee.

Through a statement the presidency stated that “some parliamentarians are trying to write a parallel constitution, through constitutional reform projects that introduce transitory articles, without modifying the current Constitution“.

“This practice is unconstitutional, violates our legal system and the rule of law, and does not respect fundamental institutions of our constitutional order, such as the exclusive initiative of the President on public spending, social security and taxes, “added the text.

“To avoid this bad practice, the Government entered today to the Constitutional Court a request to declare the project unconstitutional presented by a group of deputies -they maintained- regarding a new retirement of pension funds“.

“The aforementioned Project is not only unconstitutional. It also generates serious damage to the present and future pensions of all Chileans and benefits the highest-income people with unjustified tax exemptions, what threatens equity and Social Justice“, closed the statement.

It should be noted that the Government entered the Upper House last Wednesday, your own 10% retirement project only for active members and with limitations, establishing the reimbursement of funds that are withdrawn.
