During the morning of this Tuesday the Minister of Finance, Ignacio Briones, referred to the temporary reforms to the Constitution that Parliament has promoted and is currently promoting, specifically on the initiatives of tax to the super rich, deferral of patents, of circulation permits and even the second 10%.
In this sense, Briones pointed out that “due to the mandate that the citizens gave on October 25, mainly in favor of moving towards a new Constitution and that this Constitution be drawn up by representatives specially elected for those purposes, in this context this way of the transitory reforms that, I insist, do not talk with the permanent body of our Constitution, are eroding that step, that advance towards a new Constitution and are diluting the separation of powers that is so necessary in a democracy.

Likewise, he declared: “You have seen that there are other initiatives that have begun to flourish recurrently from taxes on the super rich, from the postponement of patents, circulation permits and other initiatives that by way of transitory modifications of our Constitution, they are eroding this healthy separation of powers that must exist ”.
Asked if they will resort as a Government to the Constitutional Court for the project of the second withdrawal of 10%, Briones pointed out that “here what corresponds is this type of situation to treat them through institutional means. If that is not possible, of course the Executive has the duty to ensure respect and watch over our institutionality, because it is a fundamental pillar for our democracy ”.
Briones’ words are in line with those stated by President Sebastián Piñera at the Annual Industry Meeting, organized by Sofofa, where he issued a harsh criticism of parliamentarians, and although he did not say it directly, it would be a clear allusion to the second withdrawal of 10% of the funds from the AFPs, as well as the initiative to change the quorum in the constituent convention.
“What we are seeing today is that a group of parliamentarians making abusive use of a loophole, a constitutional circumvention, are trying to write a parallel Constitution without modifying the current Constitution, through transitory articles”, he indicated at the time.
