Court rejected Enrique Paris’s request for 42 business days to deliver Minsal emails

This Friday, the 7th Guarantee Court of Santiago rejected the request of the Minister of Health, Enrique Paris, who had requested 42 business days to deliver the emails of the portfolio to the Prosecutor’s Office, within the framework of the investigation against former Minister Jaime Mañalich and Undersecretary Paula Daza for Covid deaths.

According to the background, the Secretary of State justified the postponement of this process for technical reasons and a “limited amount of human resources” to review 49 thousand emails under strict security measures.

The court ruling states that “It is not understandable that the administrative authority, to proceed to single out the electronic communications that correspond to the cases of exception provided for in the resolution of the Supreme Court, must, necessarily, proceed to carry out an individual review of all emails that he keeps in his power having, for this purpose, extraordinary personnel and infrastructure specially designed for this purpose“.

The above, given the argument of Minister Paris de protect national security, since part of the emails contains information about —for example— the acquisition of essential implements and supplies to face the pandemic, in addition to the strategic work around the health emergency due to Covid-19.

“It is possible to assume that, considering the nature of sensitive information, it is duly limited to certain suppliers, and has been handled by a restricted number of senders and recipients of the respective e-mails, which will undoubtedly facilitate the identification of the same ”, indicated the court.

In addition, it is stated that “if the extension were granted in the requested terms, the information would not be in the possession of the Public Ministry for investigative purposes within a reasonable period of time, unjustifiably affecting the investigation“.
