CDE lawyers go “nosedive” against Espina’s appointment: “Bury the meritocratic promise” | National

The National Association of Lawyers and Officials of the State Defense Council (CDE), through an open letter, harshly criticized the appointment of the former Defense Minister, Alberto Espina, as counsel to the organization, who must defend the interests of the Treasury.

Appointment that was made official today by the President Sebastián Piñera.

“Bury the meritocratic promise”officials and jurists said.

“The National Association of Lawyers and the National Association of Officials of the CDE, once again make present our concern and dismay over the appointment of a Counselor for this Institution, ignoring the civil service career
but, above all, neglecting technical criteria in the provision of the position, “says the letter at the beginning.

They add that over the past few years, they have seen the appointment of high-ranking officials of the CDE been publicly questioned, and that “This new designation calls into question the consideration of technical reasons for the election of the members of the Council and gives rise to increase criticism regarding the formation of this body ”.

Likewise, they emphasize that without ignoring the current legal authority of the President of the Republic to appoint counsel counsel, they consider that it should be exercised respecting essential aspects.

Technical and non-political body

“The State Defense Council is a purely technical service. In this line, the Counselors Lawyers, taking care of their tasks and position profile, must be trained to personally assume the judicial defense of those causes of greater relevance for the State and Treasury of Chile ”, says the letter.

In the same vein, they explained that the Organic Law of the Council, in its article 38, requires that Counselors must have the title of lawyer and a professional experience of at least 15 years.

“Said professional experience cannot be other than that of a litigation lawyer or outstanding academic, being these competences essential to hold the position, in order to assume either the litigation or technical advisory functions in a serious, competent and devoid of considerations unrelated to the legal, in the modalities established in the Organic Law of the CDE itself ”, they detail.

“Although it is possible that, the exercise of the power given to the President of the Republic, matters the selection of a professional who responds to that profile and who is not a current member of the Institution, It seems to us at least questionable that such an appointment falls on who was recently a member of his political team; This encourages the apprehensions and objections of the citizenry in order that the appointments are oriented towards a retribution of political loyalty, and not the selection on merit, which is what this Institution demands and deserves ”.

They also note that the foregoing denotes that “this new appointment is unequivocally shown as a gesture intended to bury the “Meritocratic promise” of which so much is talked about and with which -as usual- in campaign times we seek to conquer the illusion and hope of the voters “

Finally, CDE officials point out that They view with concern the politicization of our institution, the ignorance of the merit of the professionals that comprise it and the contempt of the Service in the exercise of its functions and in the eyes of the public.
