The director of the Internal Revenue Service, Fernando Barraza, returned to the charge after the controversy caused by the controversial decision of the body to lower taxes on the Penta group, reputed as a “necessary expense”, incurred in his defense during the trial for tax fraud. treasury and tax crimes.

The reduction, of more than $ 1.4 billion pesos, was defended by the director of the SII, who pointed out in an interview with the newspaper La Tercera, that although “the decision seems to be counterintuitive, it is in accordance with the law”, adding that ” Every taxpayer has the right to legal defense, and as a taxpayer, therefore, they also have the right to reduce the expense incurred in that defense “, regardless of their condition or size.

“That is a very relevant principle that is suddenly not understood and it seems that here there is a privilege, that there is an exception, but no, what there is is the recognition of defense spending to which everyone is entitled,” said Barraza.

The manager of the tax entity, acknowledged that he understands the annoyance of the citizens, however, he also pointed out that “it is important to be able to explain in a transparent way what are the reasons and principles that apply to this situation, since to a large extent we realize that there is a lot of ignorance ”.

The SII’s decision also had an echo in Congress, since during the week Deputy Daniel Núñez (PC) publicly requested Barraza’s resignation as a result of the controversy. The director of the agency replied regarding the reaction in the Legislature that “not because we do not like certain decisions we are going to disrespect the SII. If there is legislation that we do not like, we change the law, but that is not the responsibility of the service”.
