Despite the various arguments put forward by the Government to convince the deputies that a second withdrawal of the AFPs will only worsen the situation of current and future retirees, the Chamber’s Constitution Commission gave the green light yesterday to the three projects they give form a new 10%.
The result was overwhelming. The idea of legislating was approved by 11 votes in favor and only one against (Jorge Alessandri, from the UDI), so now the project will be discussed in particular.
The opposition, from where the projects emanated, had the support of parliamentarians from Renovación Nacional and Evópoli, despite the position of Palacio.
From there, even the Minister of the Segpres, Cristián Monckeberg, announced that La Moneda will reserve the constitutionality. They understand, as in the first retreat, that the quorum required to approve the project is 2/3 and not 3/5.
“Very happy for the deputies of Chile Vamos, that despite all the pressure from the Government, they voted in favor of the project, putting themselves in the shoes of the people ”, said at the end of the session the president of the Commission, Matías Walker (DC).
Although from Chile Vamos they regretted that workers have to use their savings to face the crisis, they also believe it necessary. “The State has not yet arrived in the best way to support the families,” said Eduardo Durán (RN).
Alessandri went further and suggested that the 10% that corresponds to each worker should be paid by the Government: “Let the Treasury write that check to people,” he said.
From the Senate, Iván Moreira (UDI), who supported the first 10%, asked the Government not to put them back “between a rock and a hard place” and provide alternatives.
10% projects
one-Consolidated project that establishes and regulates a pension fund withdrawal mechanism to face the pandemic. Contributors are authorized, “on a voluntary and exceptional basis, to make a second withdrawal of up to 10% of the funds accumulated in their individual capitalization account of mandatory contributions”. It is allowed to withdraw a maximum amount of 150 UF and a minimum of 35 UF.
two-Project that modifies the Constitution in order to allow those who retired under the modality of annuities, can access the withdrawal of funds accumulated in insurance companies, since in the first process they were excluded. Approved with 10 votes in favor and two abstentions.
3-AAs in the first withdrawal process, a project was presented that also modifies the Fundamental Charter, “to empower the Family Judge to authorize the withdrawal of pension funds from the delinquent obligor, by the alimony or his legal representative in quality of unofficial agent ”. Approved with 12 votes in favor.

That the first withdrawal of 10% of the AFPs had the support of the ruling party was key so that the Government did not present a measure to stop it. But when noticing that the parliamentarians had the same disposition before a second process, the alarms went off with force in Chile Vamos.
Clearly it is not a formula that the Executive likes, so during yesterday’s session the calls were increased in order to align the bloc. And they were not just conversations, as the same deputy Eduardo Durán (RN) recognized in the Commission: they were subjected to pressure to reject the motion presented by the opposition. A situation that even triggered several of his colleagues asking to be replaced in the instance.
The same, in any case, requested deputies who were on the other side, such as Camila Flores (RN), who although rejecting a second withdrawal, was replaced by deputy Jorge Durán (RN), who ended up approving the three projects. From the inmate they commented that they also received pressure, so they did not want to appear rejecting a popular measure before the citizens. Situations like that, as Pamela Jiles (PH) said, facilitated the debate.
