After the idea of legislating the second withdrawal of 10 percent of the pension funds was approved -in the Constitutional Commission of the Chamber of Deputies-, the General Secretariat of the Presidency (Segpres) reported that the Government will go to the Court Constitutional (TC) to block the initiative.
The initiative promoted by the humanist deputy Pamela Jiles, was approved in her idea of legislating together with the project that allows the exceptional withdrawal of funds accumulated in insurance companies, under the modality of life annuities, to benefit people who cannot access the first Withdrawal of funds.
At the end of the session, the Minister of the Segpres, Cristián Monckeberg announced that “we understand that this project has a quorum of 3/5, we consider it to be 2/3 and for the same reason we are going to make a constitutionality reservation in that matter”.
“All the constitutional and legal requirements before the Constitutional Court to consider this reservation are also understood to have been fulfilled, despite the fact that I have not been allowed to give the specific details of each of the norms that are being violated,” he added.
For his part, Undersecretary Juan José Ossa said that “I request the secretariat to register the constitutionality reservations regarding all the projects that have been approved in general in the associated minutes, in this history of the law.”
“As long as Chile does not have a new Constitution, the current one must be respected,” Ossa concluded.
Earlier, Deputy Marcos Ilabaca (PS) pointed out that “the Government has threatened all Chileans stating that it will do everything possible to block this second withdrawal of 10% of the AFPs. This shows the need to change the Constitution that It governs us. That is why I call on the Government: Gentlemen, last Sunday Chile gave a tremendous signal. Today stop being deaf and listen to what the citizenship is requesting. “
