200 thousand commercial workers without voting: the CUT appeals to the Court against the Labor Directorate

The Trade Branch of the Unitary Center of Workers filed an appeal for protection before the Santiago Court of Appeals against the Labor Directorate for the violation of constitutional rights of workers in the sector.

The national councilor of the CUT and president of the Walmart Inter-company Leader Union, Juan Moreno, assured on the eve of the Plebiscite that commerce workers are “discriminated against in being able to exercise their vote in the October 25 plebiscite.”

The appeal requests that the violation of constitutional rights be declared, infringing the right to vote and equality before the law, with respect to workers who work in commercial establishments and services that directly serve the public.

“We are asking for the constitutional rights violated to be restored, since we see how two workers with the same employer have different conditions to exercise their vote without setbacks,” Moreno said.

He added that “given the difficulties and misinterpretations of the law, it is important that the Court of Appeals clarify the point and generate reparatory measures, because about 200 thousand workers may stop exercising their right, when evaluating the opportunity cost that go to vote”.

In the CUT they point their criticism to the Government and have expressed that for at least three months they have been requesting the inalienable holiday for commercial workers, considering the vote this Sunday throughout the country.

At the same time, they lashed out at the intransigence that was also reflected in the last-minute solution regarding public transport, a measure that they also did not consider sufficient.

The president of the CUT, Bárbara Figueroa, asked the Executive to actively monitor these guarantees to avoid abuses by employers where, she said, they have already known of indirect pressure.
