The second withdrawal of 10% of the AFPs is in process. The Chamber of Deputies and Deputies grouped together the motions that seek to modify the Constitution in order to beat the economic consequences of the COVID-19 pandemic with this new withdrawal.
Constitutional procedures for the second withdrawal of 10% of the AFPs
- The project is only in the first constitutional process since September 1, when it passed to the Commission of Constitution, Legislation, Justice and Regulation of the Chamber of Deputies. There the idea of legislating must be voted on. If you have directions, the bill should be voted on again.
- If the issue is approved in that instance, it goes to the second constitutional process, when the Senate is the one that reviews it and votes.
- If you have indications, you must go to the mixed commission Where members of the two chambers must vote it again.
- If the answer is positive, it would go directly to the president’s desk, where it is enacted.
- By being published in a maximum of 5 days in the Official Gazette, it would be ready. The estimated date for that would be December 31st.
This second withdrawal of 10% of the AFPs has some differences with the first: the money will be granted in a single installment and on the subject of alimony debtors, the money will no longer need to be requested, but will only be seized that money.
