The Tarapacá Prosecutor’s Office will formalize the deputy Hugo Gutierrez (PC) for the crimes of Threats against Navy officials and denial of assistance, after knowing the record of a health check that said staff wanted to carry out and that the parliamentarian tried to evade.
After the recording of the troops made on August 8 was released, the prosecutor Eduardo Rios began to investigate Gutiérrez upon receiving two complaints, including one from the Maritime Government, as published Third.
In the video captured in Cavancha, the deputy ruled out being subject to an audit, stating to officials that for being “more authority” than them “you can’t control me”, further arguing that it corresponds to him to do this work because of his position in Congress.
Regarding the crime of denial of assistance, the Penal Code indicates that this refers to the fact that “the public employee of the civil or military order who, requested by the competent authority, does not provide, in the exercise of his ministry, the due cooperation for the administration of justice or other public service, will be punished with suspension of employment in its minimum to medium grades and a fine of six to ten monthly tax units “.
“If its omission results in serious damage to the public cause or to a third party, the penalties will be perpetual special disqualification for the position or office and a fine of eleven to twenty monthly tax units “, he points out.
The deputy has defended himself accusing having been the object of persecution by the Maritime Police on the day of the events, while the Communist Party indicated that the inspection took place in a private parking lot. The version of the Navy discards both assumptions, ensuring that the control was “adjusted to the regulations”, and that it occurred on an avenue in Iquique.
The Iquique Guarantee Court determined that Gutiérrez’s formalization hearing will be held on December 14 at 11:30 a.m.
