The The Prosecutor’s Office of Tarapacá will formalize the communist deputy Hugo Gutiérrez on December 14 for the crimes of threats against officials of the Navy and denial of assistance, in a fact that was registered on August 8 in the framework of a health inspection carried out to the parliamentarian in the city of Iquique.
The investigation, carried out by the prosecutor Eduardo Ríos, began after the presentation of two complaints, one of them from the Maritime Government, due to the fact that it was known through a video posted on social media, where it is seen as the legislator refuses to be inspected by naval troops in the Cavancha sector -in the framework of the Covid-19 pandemic- and questions them, alluding to his position in Congress.
“I am the authority”, “You cannot control me”, “I have to denounce those who control me”, “When it happens to me, I have to denounce who controls me”, “I am more authority than you” , are some of the phrases he issued at that time.
Given these facts, Prosecutor Ríos requested the Iquique Guarantee Court an hour for the formalization hearing of the deputy Gutiérrez, which It was set for December 14 at 11:30 a.m.
The second crime for which the legislator will be formalized is contemplated in article 253 of the Penal Code, and specifies that “the public employee of the civil or military order who is required by the competent authority, shall not render, in the exercise of his / her ministry, due cooperation for the administration of justice or other public service, will be punished with suspension of employment in its minimum to medium grades and a fine of six to ten monthly tax units “
It adds that “if its omission results in serious damage to the public cause or to a third party, the penalties will be special perpetual disqualification from the position or office and a fine of eleven to twenty monthly tax units.”
