The Minister of Health, Enrique Paris, answered the Supreme Court the request that she made to explain her reasons for denying delivery of emails in the framework of the criminal investigation for alleged misinformation of figures of deaths from Covid-19.
It should be noted that the Central North Regional Prosecutor, Xavier Armendáriz, requested access to the Minsal emails, however, the portfolio itself allegedly denied the Prosecutor’s Office access to the former minister’s e-mails Jaime Mañalich, of his then chief of staff, Itziar Linazasoro, and the current Undersecretary of Public Health, Paula Daza.
In the report sent yesterday Monday, the current Minister of Health asserted that the request made by the Public Ministry “is not limited to any form, neither by reason of matter, nor by reason of time, nor with respect to relevant communications, or even pertinent , nor for the clarification of the facts object of the investigation “.
According to Paris, the prosecution’s diligence “It is indiscriminate, imprecise and far-reaching.”
Paris accuses that the investigation “has hindered the performance of the ministry that I direct”, arguing that his portfolio officials have had to dedicate part of the day to “extensive statements” in the middle of his work to contain the health crisis.
It also stated that the required information compromises national security.
“The electronic correspondence of the authorities of the Ministry of Health includes decisions in instances of coordination, strategic and logistics, with respect to the acquisition of supplies necessary to face the pandemic, in a context of real risk of loss of said supplies due to actions of third countries, and on the other, includes decisions about accessing relevant information in the field of national defense“Paris said in the document.
In the opinion of the Secretary of State, the “realization of a seizure procedure (…) compromises the access and examination of documents and information of a confidential nature, whose knowledge may affect national security, in the midst of the actions of the Ministry that I lead, to control said pandemic. “
In this context, he asserted that “the acquisition of necessary implements to face the pandemic, in a context of a true ‘commercial and political war’ between world powers, with risks of seizure in any territory, which can frustrate the future reception of the referred inputs and their use at the national level. “
In addition, he explained that the emails had data related to the deployment of the Armed Forces nationwide: “The allocation of resources and police, and especially military, to strategic and logistical tasks, whose detailed information is obviously relevant to national security.”
“Today it is beginning in the countries of the northern hemisphere, the so-called ‘second hello’, what makes it necessary, what both the Ministry of Health and the Armed Forces safeguard the information that if disclosed could be counterproductive to current decisions, “he added.
Similarly, according to Paris, the request violates the reservation of the data of the infected: “It corresponds to sensitive information as it corresponds to patient data, which gives the nature of said reserved information.”
