Controversy caused the situation in Talca, where a mother found herself in the middle of the street with her cousin and the author of the crime of rape and murder of her son, which occurred in Parral in 2000, Héctor Riveros Retamal, who is currently serving the sentences of Life imprisonment and 15 years in prison, in the semi-open Center for Study and Work in Talca. All because he was with benefits granted by the Gendarmerie.

Such was the astonishment that he went to the Talca Court of Appeals, where he filed a protection appeal against the Gendarmerie “for having incurred in an illegal and arbitrary act, by granting permission to leave the free environment, without surveillance, to the condemned”. The Amparo y Justicia Foundation did the same, and it is waiting for the Talca Court of Appeals to review the protection appeal filed.

From the Gendarmerie they explained that although they granted him intra-penitentiary benefits, when the convicted person applied for conditional release and was rejected, his permits were withdrawn and later by judicial means – through an appeal – the Talca Court of Appeals and later the Court Suprema they let him out on weekends.

Due to this statement, the president of the Supreme Court, Guillermo Silva, assured that everyone holds the courts responsible for the bad things that happen.

“Everyone holds the courts responsible for all the bad things that happen. It is the easiest thing because judges are not used to getting into controversy with anyone. The blame goes beyond the courts, we judges apply the laws and laws they provided that this benefit had to be granted, “he told Bío Bío radio.

The Minister of Justice, Hernán Larraín, held the courts responsible and announced that they will present a bill to create the figure of a judge for the execution of sentences.

“It was a decision of the courts of justice that forced the Gendarmerie to replace this person in an education and work center and give him the permits, because that was the ruling,” he told the aforementioned media.
