The mayor of Recoleta, Daniel Jadue, expanded the complaint filed for deaths that occurred in the commune due to the pandemic of the COVID-19.
The legal action was filed against the president Sebastian Piñera; the former Minister of Health, Jaime Mañalich; and the undersecretaries Paula Daza and Arturo Zúñiga.
In the first place, the complaint was presented under the crimes of denial of assistance, abandonment of destination and homicide near misdemeanor.
But, with the enlargement, the authorities are now accused of reckless spread of pathogenic germs and ideological falsification of a public instrument.
The expansion of the complaint is based on the investigation carried out by the Comptroller Regarding the count of infected persons carried out by the Ministry of Health and which is in question. Therefore, they point to a forgery of a public instrument by data hiding.
“There are statements by public officials linked to the ministries in charge of handling the pandemic, who have made evident what had been raised by the Comptroller’s Office, and who endorse that Minsal itself has had to modify the definition of a suspected case for the epidemiological surveillance in the face of the covid-19 outbreak ”, it was added in the document.
“Negligence or reckless recklessness”
In addition, the defendants are accused of negligence or reckless recklessness for the crime of spreading pathogenic germs for the purpose of producing disease.
According to the complainants, Piñera, Mañalich and company generated the spread of coronavirus.
“Clearly, the defendants have committed the crime (…) because there have been the deaths of the people for whom my clients are complaining, and also in relation to the second paragraph of said article, since said consequences have been the product of reckless negligence or negligence , carried out by the defendants, who have generated the spread of the coronavirus (covid-19) with levels that have generated levels of contagion that could be avoided ”, it was added.
Ramón Sepúlveda, Jadue’s lawyer, indicated that he hopes that the investigation continues so that responsibilities are established and thus the accused are formalized.
