The National Economic Prosecutor’s Office (FNE) asks Disney for a sanction of four million dollars for providing false information in the process of acquiring Fox in Chile.
According to the document released on Tuesday, in 2018 the FNE approved the merger between both parties, with the commitment not to sell Disney channels with Fox and sports signals as a package, such as ESPN and Fox Sports.
Among the irregularities detected in the process, both parties declared not having studies on the Chilean market, a situation that contrasts with a series of documents presented by Disney, in which they even have the file name “Chile”.
With this, Disney had a period of 60 days to notify pay TV providers about the operation, instance that was fulfilled in July 2019, more than four months after the initial date.
Although these situations have not had an effect on the market, the delivery of false information and the breach of this type of measures are sanctioned, according to Article 3 bis of DL 211.
