When the government defined that some guarantees would be granted for National Holidays, such as private celebrations or in private homes, where up to 5 additional people would be allowed to residents and up to 10 people in public places, some corrections had to be made, such as, for example, that these guarantees would not be applied in communes that are in quarantine.
Subsequently, it was defined that they would be teams made up of health officials who were responsible for conducting audits, either in public or private places, so that the norm was met.
However, it was the health officials themselves, through their leaders, who made known their concern regarding their personal safety during these controls and asked for guarantees.
But until the last moment it was not clear how they would be protected, since it was defined that there were two ways to control: By complaints and flagrante delicto, and once the control was carried out, the official would determine if he called the Carabineros if necessary. But this was finally corrected and it was determined that teams would be assembled where they would be accompanied by officials of the PDI or by Carabineros, that is, by the public force, who will be in charge of protecting their integrity.
Lack of clarity in the area
Although the norm determines that the public force is the call to protect the health officials who will supervise. For some authorities there were some doubts, since the Minister of Health, Alejandro García, indicated that they would also be accompanied by Army officials. Moreover, in the audits prior to the 18th that were carried out, the officials of the Health Department were precisely accompanied by officials of the Army.
When General Jorge Tobar was consulted who would be responsible for the security of the inspectors, he indicated that it was the public force, and that this was established by the Sanitary Code.
“The document indicates that for the controls carried out by the health authority, it must be accompanied by the public force to achieve effectiveness in its decisions. And when you go to the Constitution, the public force is made up only of the Carabineros or the PDI. The Army is not part of what the public force is, ”he said.
Therefore, he pointed out that it was these entities who were in charge of the security of the inspectors.
“The Carabineros or the PDI come together to provide assistance from the public forces to the official of the Health Department who is going to carry out a control, but it is the Health Department official who is going to make the decision to want to enter (to a ), make a complaint, etc., and the Carabineros or the PDI should only support that decision and protect their integrity ”.
General Tobar also mentioned that the assistance of the security forces pursues two objectives. The first, to protect the integrity of the authority that is carrying out the inspection and second, to give speed or efficiency to the resolutions they adopt. “For example, when the health official detects an infraction, he will make a complaint decision and this will be transmitted to the Carabineros, who will have to report the fact and will have to contact the prosecutor.”
Regarding certain fears that health officials would have about the possibility of suffering an attack or aggression, the general said that for that it was the help of the public force, to protect him in case they are going to suffer some type of aggression and detain the or the aggressors, because it was an illegal act.
He reaffirmed that the public force, either Carabineros or PDI, would accompany the inspectors and that they were not going to walk alone. “For there to be an effectiveness of the assistance of the public force, these groups or control devices have to be combined and always accompanied. It would not be understood that they (inspectors) went out to do the control, exposed themselves or could not comply with what they need. Therefore, they will always have to be accompanied by the public force ”.
On what could he say to those officials who feel certain apprehensions for their physical integrity, the high official mentioned that “what I can tell you is that they will always be accompanied by public forces, as determined by the resolution of the Ministry of Health” .
The voice of the Ministry of Health
In the report on the evolution of the Covid in the region that was delivered yesterday, the Minister of Health, Alejandro García, after answering questions from the press on the subject and on who will protect the auditors, stated that the audits will be carried out “by the denunciation of the citizens themselves, regarding the fact that the necessary measures are not being carried out in a private or private place, where so many personnel from the Health Ministry will attend together with the police, the PDI or the Army. Also when a flagrant crime is detected, these are the two opportunities where inspections will be carried out inside the homes, ”he said.
Later, he explained that “we in our region have the armed teams and the specific coordination to be able to carry out the corresponding inspections in situ, whether in a house, a building, etc. The other is going to be when the police, PDI detects a flagrant crime, where you can also attend and review accordingly, as is always done, with respect to audits. “
Finally, García reiterated the accompaniment, indicating that “in addition, each of the officials of the health seremia have to carry their credentials and they will always be accompanied by the police force, the PDI or the Army.”
