While waiting for the Supreme Court to decide on the requirement of the North Central Prosecutor’s Office, on the documents for deaths of covid-19 protected by the Ministry of Health, the Executive confirmed that they will cooperate if the Justice so establishes.
The Minister of Health, Enrique Paris, who denied the request of the Prosecutor’s Office in the first instance, assured that they will deliver all the information that is requested, as long as the judicial body determines it.
“If the Supreme Court requests it, we are ready to cooperate. (We will deliver) everything that is requested by the Supreme Court. And we have always done it that way, “the Health Minister briefly stated.
For his part, the Minister of the Interior, Víctor Pérez, said that the corresponding defense is being filed, since he ensures that the request of the Public Ministry includes documents that do not refer to the case. “Our lawyers and the lawyers of Minister Mañalich are going to use all the resources and we hope that this will be resolved well. There is a lot of information that we believe has nothing to do with the situation “. said
Meanwhile, from the legal firm GYS Abogados, the lawyer Roberto García clarifies the points raised in the controversy and maintains that the defense of the Prosecutor’s Office is more robust than that of the Ministry of Health.
“The Public Ministry has the power to request these documents and this information from the Ministry of Health. And the justification for preventing or not delivering them, because they could be documents that could hinder the exercise of their functions and violate the rights of patients or deceased, is super weak, “explained the lawyer.
The request for documents occurs within the framework of the complaint filed against President Sebastián Piñera, the former Minister of Health, Jaime Mañalich; in addition to the Undersecretary of Public Health, Paula Daza; and the Assistance Network, Arturo Zúñiga, for the possible crimes of denial of assistance and quasi-felony of homicide in handling the pandemic.
