Lower House approved the constitutional accusation against Judge Donoso

The Chamber of the Chamber of Deputies and Deputies approved this Thursday the constitutional accusation presented against the judge of the Court of Appeals of Valparaíso Silvana Donoso, in the framework of the Ámbar case.

With 73 votes in favor, 52 against and 14 abstentions, the Lower House approved the origin of the accusation for alleged “notable abandonment of duties”, so now this will go to the Senate, who will act as a jury and must vote whether or not to remove the magistrate.

Until then, Donoso will be suspended from his duties.

The minister is accused because she presided, in 2016, the commission on conditional liberties of the appellate court that that year granted the benefit to Hugo Bustamante, who was serving a prison sentence for a double homicide and today is charged with the crime of the minor Ámbar Cornejo in Villa Alemana.

Before this vote, the deputies had already rejected the “preliminary question” presented by the defense of Judge Donoso regarding formal matters of the accusation.

The accusatory libel, presented last August 13 by the deputy Andrés Longton (National Renewal) and supported by parliamentarians of the Christian Democracy and the Social Green Regionalist Federation, managed to advance in the Chamber, despite the fact that the commission to this it had recommended rejecting it – a definition that is not binding.

The next step in the Senate, the accusation will be informed by a commission made up of Congressman Longton, his peer RN Gonzalo Fuenzalida and DC Daniel Verdessi.

“IT’S UP TO THE SENATE TO PROVE THAT THEY ARE WITH THE VICTIMS”

He MP Longton he celebrated the approval of the accusation that prompted and started the Upper House to dismiss the judge.

“Now it is up to the senators to show that they are with those who have had to suffer from these mistakes,” he said.

SUPREMA SAYS YOU ARE AT RISK OF THE RULE OF LAW

The Supreme Court, for his part, he has constantly expressed his support for the minister arguing that she exercised her work and acted applying the law in force at the time of the resolution that is now being questioned, four years later.

“The minister concurred, with her vote, to said decision that was adopted in accordance with the regulations in force at that time, which is not the same that is currently in force, since the decree of law (321) that regulates the conditional liberties regime underwent modifications in 2019 establishing new requirements, “said the minister spokesperson, Gloria Ana Chevesich, on August 13, when the deputies entered the accusation.

Also, in the previous days, in the commission to this who analyzed the accusation, the president of the highest court, Guillermo Silva, asked the parliamentarians not to “populism” and warned that if this accusatory libel prospers, the rule of law and the independence of the Judiciary will be put at risk, as published Third.

“The Supreme Court and the Judicial Power as a whole are assisted by the conviction that without judicial independence no right is possible. In its absence, the entire society irremediably loses the possibility of access to justice and the reaffirmation of the validity of the right , which is what we judges do when we decide, “he said.

“We judges owe ourselves to the law and nothing more than the law. And the day that this stops being the case and that for fear of sanctions or reprisals judges must look with one eye at the right and with the other the imminent risk of being constitutionally accused, removed from our positions or reprimanded, we will no longer be speaking properly of a democratic state of law “, he exposed.
