This Monday, the lawyers representing President Sebastián Piñera, former Minister of Health Jaime Mañalich and undersecretaries Paula Daza and Arturo Zúñiga, of Public Health and Assistance Networks in the investigation for alleged “acting negligent and serious” in the COVID pandemic -19, they asked the national prosecutor, Jorge Abbot, to remove the persecutor Marcelo Carrasco, from the Central North High Complexity Prosecutor’s Office.
Carrasco was appointed three months ago by the Public Ministry to process this case, which was opened after a complaint filed by the mayor of Recoleta, Daniel Jadue (PC), for the death of 62 residents of the commune was declared admissible during the health crisis.
According to the newspaper La Tercera, Samuel Donoso, Gabriel Zaliasnik and Eduardo Riquelme appealed to the National Prosecutor’s Office accusing that Carrasco and his assistant lawyer, in a hearing held on July 23 before the Sixth Guarantee Court of Santiago, issued opinions that would violate the principle of objectivity.
“What shows the partial and interested position of the prosecutor in charge in order to tend to the procedural intervention in the investigation of Mr. Jadue and other militants of the Communist Party, is that he shamelessly pointed out that ‘we are objective, what we cannot do Your honor is simply (to be) neutral in a case like this, ‘”argued the lawyers in their presentation, according to the aforementioned media.
“Mr. National Prosecutor, the seriousness of that statement alone merits access to this request. It is making a dead letter of the principle of objectivity knowing the null or scarce control that exists in our legal system for this type of infraction,” they added.
Pñera, Mañalich, Daza and Zúñiga are accused of being the perpetrators of a quasi-crime of homicide and denial of assistance.
