The recording of the GoPro camera of the Carabineros captain Jaime Fernández Sepúlveda is one of the key pieces of the Western Prosecutor’s Office to impute participation to the ex-officer Patricio Maturana Ojeda, at the launch of a lachrymatory bomb that would have hit the face of Fabiola Campillai, on November 26 in San Bernardo. At that time the woman was waiting for locomotion to go to work. The severity of the injury left her blind and since then an investigation has been opened in the Public Ministry to detect the person or persons responsible.
Nine months after the fact, this Thursday at 11:00 p.m., Maturana was arrested by officials of the PDI Human Rights Brigade for allegedly unlawful pressures and very serious injuries to Campillai, and tonight, preventive detention was decreed against him while The investigation lasted, the established term of which was 90 days.
Maturana must comply with the precautionary measure within the Pudahuel Norte Police Station, same compound where the former lieutenant colonel is being held Claudio Crespo, formalized in the case of Gustavo Gatica.
The order to arrest Maturana was requested by the prosecutor of Alta Complexidad Occidente, Paola Zarate, to the San Bernardo Guarantee Court. On Friday afternoon, the persecutor formalized the investigation against the ex-uniformed man, in which she related what would have happened on the day Campillai lost her sight.
According to what was detailed by Zárate, Maturana was next to a police picket at the intersection of Avenida Portales and Fermín Vivaceta around 8:00 p.m. that day, while demonstrations were taking place a few meters from the place.
As held by the persecutor, “Contravening the provisions of the manual for the control of public order, with regard to the proper use of non-lethal weapons”, Captain Jaime Fernandez, who was in charge of the procedure, He used his gas launcher against a group of protesters located 100 meters away.
Later, Fernández gave the order to shoot a second time, the one that was executed by the lieutenant Jorge Garrido, who also carried the same type of weaponry. Finally, At 9:30 p.m., it was Patricio Maturana who fired a shot, hitting Campillai in the face, who was 51 meters away, at the intersection of streets Fermín Vivaceta and Ángel Guido.
Zárate pointed out that said action was carried out with the presence of protesters and “without thereby affecting the free movement of pedestrians and vehicles or endangering the life or safety of the people who were circulating in the sector at that time, nor that of the police officers ”.
He stated that Maturana, “Abusing his position and with the purpose of uttering pain, he fires a shot with the gas launcher he was carrying, which is struck straight ahead, directing it directly to the people located in the place, at an angle of less than 10 degrees, without making any parable ”.
Similarly, the prosecution indicated that, after realizing the fact, the group of officials left the place at the instruction of Fernández, who also instructed that a hand grenade be thrown, which fell at the feet of the victim’s sister, Ana María Campillai, who was requesting help.
Regarding injuries, Zárate reported that “The victim lost the vision of both eyes due to the bursting of both eyeballs, presenting various fractures of the bones of the face and skull, which caused total blindness and loss of the sense of smell, as well as various notorious physical and aesthetic consequences that caused the aforementioned impacts ”.
Similarly, he indicated that “If effective and timely relief had not been provided, the injuries suffered by the victim could have caused his death.”
As evidence, the Public Ministry exhibited a report from the University of Chile, “On the dynamics of tear gas projectiles in the context of the case for very serious injuries”, the one that revealed the angle at which the tear gas would have been fired.
Likewise, Zárate reported that there is a video recorded by Carabineros officials on that day, in which you can listen to ‘Matu seems to have hit him, hit him with a …’ “.
On August 14, through a statement, the Carabineros indicated that as a result of the investigation, two junior officers were dismissed. Although their names are not reported, according to those familiar with the decision, it was Maturana who was charged “Although he learned that there was an injured person, he did not display any initiative, in addition to declaring contradictory facts about what happened.”
Catherine Lathrop, Maturana’s lawyer, pointed out that her client did not carry a precision rifle, so there is no way to prove the intention to injure the victim.
Campillai, meanwhile, pointed out that “there are more people responsible. They don’t go it alone. Protocols that were not followed are followed. There are many who knew what had happened to me and with their own cameras they did nothing ”.
