“There are no rights without duties”, raised the director of the National Institute of Human Rights, Sergio Micco, words that did not leave anyone indifferent and provoked outrage within the body and in opposition politicians.
Micco was interviewed in this Saturday’s edition of The Mercury, where, in addition to rights, he spoke of duties, in the context of the health crisis due to the coronavirus pandemic and the social outbreak of October, and he expressed his intention to give a new dimension to the NHRI: more value.
“Undoubtedly we have not done enough to communicate one of our truths: there are no rights without duties”, He stated, exemplifying it with the current health situation: “We are seeing this dramatically today, the right to health does not mean anything if there are no health personnel who are literally willing to die doing their duty, which goes beyond what is required.”
He also noted that “what I have seen very strong after October 18 is the duty to participate, the joy of doing it, the experimentation of what Hannah Arendt called ‘public happiness’. I see other duties less clearly: for example, the right to freedom of expression, I cannot but condemn the funas and trolling“
“I remember a saying from my time: ‘I do not share your opinions at all, but I would be willing to die for defending your right to express them.’ As well as I cannot understand that expressions of joy are shown when Chileans violently face Chileans: Is there something to applaud? “
Sergio Micco declares in El Mercurio that there are no human rights without duties. This is false and seriously undermines the doctrine of human rights that underpins his mandate as a representative of the NHRI. “The unconditionality of human rights is unknown”, accuse counselors
The interview, however, generated harsh reactions within the NHRI: five of the 11 directors of the Institute -Consuelo Contreras, Debbie Guerra, Yerko Ljubetic, Salvador Millaleo and Margarita Romero– issued a public statement rejecting Micco’s statements, which they considered “extremely erroneous”.
“Not knowing the unconditionality of human rights is especially inexcusable in an NHRI director, evidencing a completely false approach about what should be the management of an institution that is due to the irreplaceable function of protecting and promoting the human rights of all the inhabitants of the territory, at all times and against any violation or threat, especially in the current circumstances of crisis, “they question.
In this context, although they recognize that Micco “has, like anybody, every right to uphold their personal convictions”, they criticize that “in their capacity as representative of the NHRI, they cannot impose them, disfiguring and attacking elementary concepts of the doctrine of human rights, as they are understood in the Constitution and in the international instruments that serve as essential foundation to the mandate of the institution that corresponds to lead “.
The enjoyment and exercise of human rights is not subject to the fulfillment of any duty. The only duty in this regard is that which is incumbent on the State to guarantee them without discrimination.

In turn, the Association of Officials of the NHRI (Affindh) also lashed out at the director and maintained that “the enjoyment and exercise of human rights is not subject to the fulfillment of any duty”, while “the only duty in this regard is that which is incumbent on the State to guarantee them without discrimination”.
Carmen Hertz refloated reciminations to Micco designation
Nor were they indifferent in the Communist Party, where they reacted the deputy Carmen Hertz and her peer Hugo Gutiérrez, who attacked the appointment of Micco as director of the NHRI, which occurred in late July 2019.
Hertz refloated his recriminations at the time and assured that “they named Sergio Micco precisely because of that profile, very ignorant in human rights matters, obsequent with @sebastianpinera and delivering unfounded ‘opinions’, such as denying the systematic nature of human rights violations. “

“In one sentence, Micco throws all the human rights doctrine into the garbage can. and the fight for its defense and promotion. A person who thinks that way cannot be the director of the NHRI, only shows his servility to power, which is the opposite of what “someone who defends human rights” must “do,” added Gutiérrez.
