14 Hietzing Clinic employees were fired for attending a retirement party. They are now taking legal action against this decision. The starting point of the cause is a farewell party for an employee who is now retiring. The city of Vienna, as the employer sees a serious offense, the lawyer of those affected sees it differently.
The incident occurred in late February, according to information from the APA. A total of 17 domestic workers or department assistants are said to have not been too careful to keep their distance and wear masks. The hospital management finally found out about the pension party due to anonymous information and photos shared on social networks.
Dismissed lawyer appeased
Thomas Mödlagl represents women and describes the events as follows: On the occasion of her upcoming retirement, one of the women organized a small celebration in a room that was not affected by the daily life of the hospital. He organized a small buffet and gradually welcomed his colleagues and provided them with drinks.
From lunchtime, the companions came by and presented a gift basket for the jubilee. Those women who were assigned to work that day had toasted non-alcoholic beverages.
Then the masks were removed for farewell photographs. None of those present had been present for more than 30 minutes, according to Mödlagl. In addition, not all people were present at the same time, emphasized the APA lawyer.

Employer takes action
The city of Vienna, the patron saint of women, took rigorous measures. The 17 people affected were given the option: either the amicable dissolution of the employment contract with waiver of severance pay or dismissal without prior notice. Only two women agreed to terminate the contract, one person is a staff representative who has not yet been fired. For the lawyer, the employer was “outbid.”
The health association that operates the Hietzing Clinic contradicts: “All the employees of the clinics and care centers of the Vienna Health Association have a great responsibility (…). 30,000 employees are up to this responsibility all days, and for more than a year. in particularly difficult conditions. In light of this, we cannot tolerate such irresponsible behavior under any circumstances, “said a written statement to the APA.
Various infractions
Such gatherings are “of course strictly prohibited” since the outbreak of the pandemic. The fact that the party took place during working hours, that alcohol was partially consumed, and that the apparent breach of Covid protection regulations was documented in photographs also angered the employer. The “multiple breaches of duty” would have moved the collegiate leadership to the consequences.
The women’s complaint was presented to the Social and Labor Court in mid-March. It points out that the women did not motivate the dismissal and were therefore illegal. The first negotiation dates have already been announced.
