Brandstetter case: VfGH provided administrative assistance to prosecutors

The prosecution had already appeared before the supreme court on Thursday. He wanted Brandstetter’s electronic equipment, which is being investigated on suspicion of breach of official secrecy. The order was eventually delivered to Brandstetter’s attorney’s office.

FPÖ outraged

The FPÖ is outraged that the former Minister of Justice wants to remain a constitutional judge despite the investigation against him. She gives responsibility for this to VfGH president Grabenwarter, who “cools the Wall” for Brandstetter, as liberal constitution spokesperson Susanne Fürst writes in a broadcast.

The fact that the investigators pick up a supreme judge of the Constitutional Court to confiscate his laptop is a unique process to which the Grabenwarter does not even begin to do justice with his non-declaration. In fact, on Friday the Chief Justice had just published a statement from Brandstetter announcing his whereabouts. Only the Constitutional Court itself could secure a dismissal with a two-thirds majority.

Operations related to home searches

Why it works in the case: Brandstetter is said to have betrayed a house search to investor Michael Tojner, who was a client of the former minister and a longtime friend of his. In this context, Christian Pilnacek, section chief of the Ministry of Justice, is also being investigated. There it was suspended. All involved have denied the allegations.

The fact that Tojner and Brandstetter suspected that the search of the house in connection with a real estate business arises from the file from which the Hurry quoted online. This is argued by their legal representatives with the corresponding inquiries of the journalists in advance. A central element of the investigation is likely a message from Brandstetter to Tojner on the day of the raid: “If they come today, keep calm. Appealing against this HD makes perfect sense. (…) He can be reached by SMS! Overcome!” By the way, the latter is a socialist battle song from Chile. By the way, the day before the search of the house, Brandstetter was at the Ministry of Justice. There it is said that he had an appointment with the then expert minister Clemens Jabloner, writes the Hurry.

Tojner’s attorney, Karl Liebenwein, stated in a written statement Saturday that there was no information from Brandstetter about the raid. This only provided recommendations on what to do in the event of a house search. The correspondence between the two shows a “natural vote and legal advice on the ongoing process.” Tojner had been informed about the action through the media. This was reported to the WKStA through lawyers.
