The Austrian Chamber of Commerce wants to postpone the entry into force of the planned Interior Ministry law for a few months. According to the Ministry of Labor, it will go into effect on April 1. “We reject this moment and urgently request a later entry into force, around July 1, 2021”, says in the opinion of the WKÖ, Department of Social Policy, in the evaluation process.
The WKÖ wants a postponement, as the internal implementation of the new regulations needs a reasonable deadline. Individual and company agreements would have to be modified or new ones concluded, human resource management models adapted, and issues of work equipment and cost reimbursement clarified.
In addition, the change in the tax law conditions required an internal implementation effort, especially in payroll accounting or in the framework of registries, but above all an external effort to reprogram the corresponding salary software. For this, companies need a few months in advance.
In principle, the WKÖ welcomes the regulations envisaged for the home office, which are largely based on an agreement with the social partners. She speaks critically, like many others in the evaluation process, regarding determining the location of the home office in the employee’s apartment, this appears to be too limited in law. Here a more “open” formulation would be desirable.
