LH Mikl-Leitner: Together we were able to build a strong and successful Lower Austria on the basis of the state constitution
St. Pölten (OTS / NLK) – On November 30, 1920, the Lower Austrian Landtag passed the Law on the Constitution of Lower Austria. On the occasion of this anniversary, on Monday at the Landhaus in St. Pölten in the presence of Governor Johanna Mikl-Leitner and President Karl Wilfing, as well as the authors Univ. Univ. Professor Peter Parycek and the retired head of the state parliament Karl Lengheimer presented the commemorative publication “One Hundred Years of the State Constitution: Reflection and Challenge”.
The 1920 state constitution was a “milestone” for Lower Austria and the subsequent development of the state, emphasized Governor Mikl-Leitner. Due to the crown, there was no ceremony and a commemorative post was published. “To show that we have a sense of tradition and history and also to show that we show respect, appreciation and gratitude to the generations that came before us,” says Mikl-Leitner. A “strong and successful Lower Austria” was built together on the basis of the state constitution. The governor not only thanked everyone who passed the state constitution 100 years ago, but also “filled it with life” over the past 100 years.
Today, Lower Austria has an independent path in cultural and scientific policy, a pioneering role in climate protection and with the state health agency, Mikl-Leitner continued. On the way forward, trust is needed, and the founding fathers of Lower Austria also demonstrated this trust in difficult times. “This trust, this cohesion and this union” is also necessary now to be able to overcome the current challenges.
The provincial governor also recalled the Separation Law of December 29, 1921, which came into force on January 1, 1922, and which had received “full sovereignty as a federal state” with Lower Austria. “We want to celebrate this occasion with dignity in 2022.”
The speaker of the state parliament, Karl Wilfing, described the 1920 state constitution as “an important foundation for Lower Austria”. With this, Lower Austria “took its destiny into its own hands. “The state constitution clearly stipulated how Lower Austria would be designed, what the political rules would be like, and which regions and municipalities belong to it.” Wilfing also made a clear commitment to the “federal state.” The federal state ensures “a balance between conurbations and urban areas.” He also recalled the great constitutional reform that came into force in 1979. The constitution has to “harmonize” with developments over and over again. And they will hold onto that in the future.
For former head of state parliament Karl Lengheimer, the 1920 state constitution was a “constitution of the rule of law.” The new constitution, which came into force in 1979, contained for the first time provisions such as the “definition of state objectives” and the “principles of state action.” Furthermore, for the first time there was also the possibility of “challenging legislative resolutions of the state parliament”.
Univ. In his contribution, Professor Peter Parycek addressed a “journey into the digital future of administrative and constitutional law”. Univ. Prof. Peter Bußjäger, who was unable to attend today’s presentation of the commemorative publication for scheduling reasons, with the “emergence of the Austrian federal state in a contemporary historical context and in an international comparison”.
The commemorative publication contains, among other things, the state constitution in its resolution of November 30, 1920, the verbatim minutes of the state parliament meeting at that time, as well as the current state constitution and is now available from the state administration ( post@noel.gv.at) or on the website of the Lower Austrian Parliament at noe-landtag.gv.at in the service area.
