The new crown rules also provide for curfews – politics

Health Minister Anschober has presented his new revised draft of the crown law to parliamentary clubs. Say what.

Shortly before midnight, the text was ready and sent to the parties for review. The revised draft by Health Minister Rudolf Anschober (Greens) foresees changes to the Law on Epidemics, the Law on Tuberculosis and the Law on Covid-19 measures.

SPÖ and NEOS are upset that they only received the documents on such short notice that the FPÖ is furious. Kickl described the draft as “martial law of health policy and continued overexploitation of basic and civil rights” and denied dialogue on it.

In the draft, the document is “today“Before, it is about obtaining a legal basis for the Corona traffic light and its regulations on the ground, giving state authorities the opportunity to take different regional measures.” Given that a complete blockade is not currently being considered for the second time, it should be possible to take differentiated measures based on the regional epidemiological situation ”, it says in the legal text.

In addition, it should also create a legal basis for strong curfews. The first version of the latter was overturned by the Constitutional Court.

Five reasons

“If preventing the spread of COVID-19 is critical, in particular to avoid an imminent collapse in health care” and the measures taken so far are not enough, people should only leave their own apartment for these five reasons:

➤ Avoid immediate danger to life, limbs and property,
➤ Supervision and assistance to people in need of support,
➤ Covering the basic needs of daily life,
➤ Professional purposes, if necessary, and
➤ Staying outdoors for physical and mental relaxation.

Unlike the original draft, curfews in the now revised version should have to be approved by the main committee of the National Council. Likewise, less severe entry bans in production facilities, workplaces and means of transport and in public places must now pass to the National Council.

Kickl: the government wants to “snoop”

What remains intact is the private living room, including gardens and garages, etc. Even after these changes, the government cannot impose restrictions here. But, and this is what the president of the FPÖ club, Kickl, finds, premises that are not rented for residential purposes do not enjoy this protection. “In any case, with this amendment, the government is gaining the right to snoop on club premises, but also on non-public sports facilities and on premises that are not rented for residential purposes,” Kickl said.

If the new Covid-19 Measures Law in this version is approved by the National Council, it will be in force until December 31, 2021 until another change: the validity will be extended for a full year.
