Creating a legal basis for Corona’s stoplight measures threatens to be delayed. The SPÖ announced that it might not pass the Covid law in the Federal Council, the FPÖ would follow suit.
If the government relies on a legal basis to implement the crown traffic light measures, it will take even longer with the planned adjustment. Because SPÖ and FPÖ announce in the newspaper “Austria” that they do not want to pass the Covid law envisaged in the Federal Council. In extreme cases, this can result in a delay of weeks.
Red-blue could delay the Covid law by the Federal Council
The vice president of the SPÖ club, Jörg Leichtfried, specifically announces that he does not want to pass the law, at least in the current version, both in the National Council and in the Federal Council. While the former is politically irrelevant, the latter could result in a delay of up to eight weeks.
The use of the traffic light is chaotic and incomprehensible to Leichtfried. The traffic light does not even appear in the Covid Law. The office of the head of the FPÖ, Norbert Hofer, joined the rejection of “Austria”.
This means that the coalition will likely face negotiations with social democrats and / or libertarians. After all, Health Minister Rudolf Anschober (Greens) has already announced more precise details of the law.
Resolution scheduled for the meeting of the National Council on September 23
The opposition, which has a majority in the regional chamber, basically has two options to present its rejection. If you actively veto the matter, the National Council can still move forward with the matter after a few days through a persistent resolution. However, if the law is simply left behind, that is, if it is not discussed in the plenary session of the Federal Council, there is a delay of up to eight weeks. So the legal basis for the traffic light measures could not be created until the end of November.
Of course, the government has a legal opinion that at least the requirement for extended masks in commerce and for restaurant employees in districts marked “yellow” can also be enforced by ordinance. For other measures, such as the number of events restrictions, they actually wanted to use the new law as a basis. The decision is scheduled for the National Council meeting on September 23. The next Federal Council is scheduled for October 8. Of course, special sessions are also possible, which could speed up the procedure.
SPÖ is waiting for changes at the moment
In the SPÖ, it was emphasized to the APA on Saturday night that the Federal Council had not yet made a decision on a delay at the Corona traffic light.
Although they are not satisfied with the currently available version of the relevant law, they are waiting to see what the changes announced by Anschober will actually look like.
