Whirlwind Over Novel: The Pitfalls of the Anschobers Before Corona’s Fall

1) Again, there is no solid basis for exit bans

We recall: the Constitutional Court revoked the March and April exit bans because the ordinance did not comply with the law. In the amendment that supposedly fixes this, it is now said that “certain” or “public” places can be banned. But it is not clear what is meant by this, criticizes the constitutional service. Without a precise justification, future exit bans could again go too far.

In addition, the authorities can verify “on site”, when “entering”, it is indicated in the prospectus. The Administrative Judges Association is skeptical – that could mean that police officers are investigating private apartments, which would be interference with house rules or even the human rights convention. Already in the controversial Easter decree in April it was feared that the police would go through the family celebrations.

2) The baby elephant stands again on shaky legs

The new regulations on the minimum distance would also refer to this step. The minister could stipulate that in “public” or “specific” places a distance of one to two meters should be maintained between people outside the home. Once again one wonders: where exactly? Also in private apartments?

3) “Contact tracing” is not practical

Companies, organizers and clubs must store the data of their visitors and employees for 28 days and make it available to the health authorities if a case of Covid-19 has arisen. The catch: you don’t have to give up your data and you can’t be denied access.

Restaurateurs fear that their guests will provide incorrect or non-existent data. The Chamber of Commerce now announces that “the effort of the companies is disproportionate to the profit.”

4) It is not clear who is in charge of the Corona traffic light

The amendment regulates that districts and countries can, in the future, issue rules themselves, depending on the situation of Corona in their region, which should be shown by a new system of traffic lights. However, the minister can issue stricter regulations. In a statement he is perplexed as to what “stricter” means, at least it is not a legal term.

The point is: the Corona traffic light starts on Friday, but the amendment is not yet ready for a decision. Until it is approved by the National Council, the issue of competition is likely to continue to cause confusion. The guidelines with a catalog of measures for the regions are also not available yet, but they definitely need it by Friday. (see schedule below).

5) Bad vibes in turquoise and green.

Chancellor Kurz said in KURIER’s interview on Sunday that the Health Minister enjoyed his trust. But one hears that the turquoise side of the government is increasingly annoyed with the chaos the attack is causing, while pampering the crown professional for the outside world.

The Greens attribute the bad mood to “envy.” Anschober got too close to Kurz in terms of image values. They see themselves more and more victims of “faults”. Most recently, when Kurz rushed to give a speech on the status of the crown, even though this was Anschober territory.
