JOHANNESBURG – The state capture commission has heard more shocking evidence about Transnet’s payment of legal costs by former CEO Siyabonga Gama.
This is after he lost an unfair dismissal case against the state company, and the board also decided to settle with Gama against the advice of his legal team.
Former legal chief Siyabulela Mapoma concluded his evidence in the state capture commission.
“The fact that you are saying that Transnet has a very good case, but she knows that Transnet is trying to reach an agreement or that some people within Transnet are saying that we are going to reach an agreement, so she is saying ‘Why then are we fixing ourselves?’ Then the president says, ‘We don’t know,’ ”Supreme Court Vice President Raymond Zondo said.
Another chairman of the board he found deficient, Mafika Mkhwanazi was trusted to protect Transnet’s interests, but under his supervision, the SOE decided to pay a settlement with Gama even though the legal team believed it could win the case against him. .
“I entered that meeting, President, with information that the board had already made this decision,” Mapoma explained.
Zondo said: “It goes to the previous question that Mr. Myburg posed earlier, that is, where was he reading that Transnet has a very good case, so we put off to find a deal … the two do not go hand in hand.”
Mapoma has finalized its evidence and the commission will hear testimony from Bowman Gilfillan director Christopher Todd on Thursday.
