Durban – A DURBAN judge has described the evidence against convicted murderer Mohammed Vahed Ebrahim as overwhelming.
Ebrahim, 44, was found guilty of the planned and premeditated murder of Miguel Louw, 9, in July 2018.
In convicting Ebrahim, Durban High Court Judge Jacqueline Henriques said there was a “plethora of evidence” against the defendant and, when viewed in its entirety, the case against him is overwhelming.
“This is all the more so when the accused, as is his constitutional right, chose to remain silent in the face of the evidence.”
Henriques said that in reaching his conclusion he carefully analyzed the evidence and considered probabilities and improbabilities, contradictions, inconsistencies, deliberate falsehoods and, most importantly, the conduct of all witnesses.
“Having exercised my mind and carefully analyzed the evidence presented, I consider that the odds are overwhelmingly in favor of the State’s case.”
Henriques said he “did not hesitate” to reach his conclusion. Based on the overwhelming cellular, medical and forensic evidence, the State had proven its case.
At the conclusion of his trial, he expressed his gratitude to all involved for their understanding of the time it took, given current commitments, administrative issues, and closure directives issued as a result of the Covid-19 pandemic.
The sentence will take place tomorrow.
