The court orders Motsoeneng to return the money

Former SABC COO Hlaudi Motsoeneng was ordered to return more than 800,000 rand that had been used to pay legal fees while working for the national broadcaster.

According to the Special Investigation Unit, the order, issued by the Gauteng High Court, stated that Motsoeneng should return R 851,981.73.

The unit said its investigations into the SABC found certain irregularities, including the illegal use of SABC funds by Motsoeneng to finance his personal legal process.

“In order to recover the money, the SIU, together with the SABC, approached the High Court to recover the legal fees paid to Majavu Incorporated by the SABC when Mr. Motsoeneng was fighting a decision to annul his appointment as director operations. Mr. Motsoeneng illegally obtained payment of legal fees from SABC, even though the legal services were contracted in a personal capacity, “the unit said.

Furthermore, the SABC had not instructed Majavu Incorporated, but incurred an expense of R951 981.73 in legal fees. The invoices included an invoice for a reimbursement of R100,000 in respect of a personal loan allegedly made by Majavu Incorporated to Motsoeneng.

According to the court order, Motsoeneng has to pay the money with interest from the date of the summons to the date of the final payment. You must also pay the costs of the interlocutory claim and the costs of the default judgment.

The head of the SIU, attorney Andy Mothibi, has welcomed the Superior Court ruling.
