CAPE TOWN – Former Eskom CFO Anoj Singh will present no evidence before the state’s arrest investigation on Wednesday.

Singh’s legal advisor told the investigation that Singh was unable to testify on Wednesday and provided an affidavit stating the reasons.

State Capture Commissioner Raymond Zondo said the reasons did not convince him, but decided to postpone Singh’s testimony after finding flaws in the subpoena requiring Singh to be on the witness stand Wednesday.

The subpoena concerned an affidavit that Singh has not yet submitted to the commission.

Singh’s evidence has been eagerly anticipated, but will not be heard on Wednesday. His lawyer, Anneline van den Heever, dropped a bomb at the beginning of the hearings.

“Our client is not in a position to provide evidence as stated in this document. Nor was he in a position to present his affidavit under the directive due to the reasons stated here.

Supreme Court Vice President Zondo said the reasons given in an affidavit did not persuade him why Singh was unable to testify as planned, as he had three years to prepare.

Zondo then issued the following order: “The hearing of Mr. Anoj Singh’s evidence has been postponed until a date to be determined. Mr. Anoj Singh is ordered to hand over to the commission before the close of business on Monday, January 18, 2021. “

The commission has been postponed until 4 p.m. Wednesday, when another witness will be called.
