Former President Jacob Zuma’s attorney has strongly suggested that he “won’t say anything” if forced to appear before the State Capture Investigation, but the commission insists that Zuma has no right to remain silent the next time he appears before it. .

“The right to remain silent that Mr. Zuma threatens to invoke is only available to a person arrested or accused in a criminal proceeding,” argues the investigation in documents presented in the Constitutional Court. “None of these provisions apply to Mr. Zuma when he appears on commission.”

The investigation will request the Constitutional Court this Tuesday to issue a series of orders against Zuma, which, it alleges, are aimed at ensuring that he is held accountable for his conduct as president when he returns to the investigation on January 18 and 22, and January 15.
