The 17-year-old mother appeared in the Juzgado de Paz de Protea juvenile court.

Her 30-year-old lover, who is also the victim’s stepfather, appeared separately in a packed courtroom.

Magistrate Audrey Mpofu warned the boyfriend that he was facing List 6 crimes and that he would need to be represented by an attorney.

“If convicted, he can remain in jail for the rest of his life. Rape of a minor carries a prescribed minimum sentence of life imprisonment, murder with aggravated circumstances also carries a life sentence, while Child abuse carries a minimum sentence of 10 years in jail, “Mpofu warned the man.

The defendant, who seemed calm, replied that he would need a lawyer to defend him. He said he intended to submit a request for bail at his next appearance next month.

State prosecutor Thami Mokgoko told the court that they will object to the bail.

It is alleged that the victim was allegedly raped and assaulted at her stepfather’s home in Diepkloof.

The minor subsequently succumbed to her injuries at Chris Hani Baragwanath Hospital on November 19.

The couple were detained Tuesday after a police investigation.

Police spokesman Brigadier Mathapelo Peters said that on November 16, members of the Family Violence, Child Protection and Sexual Crimes (FCS) were summoned by a doctor at the hospital (Baragwanath), who alerted them to the rape of a two year old boy. older child.

The victim had been assaulted and was taken to the hospital on November 15 to receive medical attention.

“An urgent forensic investigation was initiated and all relevant forensic evidence was collected for processing by the SAPS Forensic Sciences Laboratory. It was not until November 17, 2020 that the victim’s mother, aged 17, arrived at report the incident to the police.

“However, this helped the police obtain vital information to build a strong case to secure arrests.

Preliminary police inquiries established that, on November 15, the mother had left her daughter in the care of her boyfriend for about two hours.

“Upon his return, around 8:30 p.m., he allegedly found that the groom was not around, but that the groom’s father was at home and the boy was asleep. He went to sleep without wanting to disturb the boy,” Peters said.

The mother claimed that she woke up in the middle of the night to see how the boy was doing, only to find the boy with serious injuries to his face.

Admitted with injuries

“She took the boy to the nearby Chris Hani Baragwanath Hospital for medical attention. The result of the medical examination found that the boy had been penetrated and it was then that the doctor called the police.”

“Sadly, the boy succumbed to injuries and was certified dead on November 19, 2020. The initial case of assault with intent to cause serious bodily injury was later changed to murder.

“Investigations continue, awaiting the outcome of the forensic analysis as the police seek to build an airtight case that can be brought to court and see justice done.

“The police have reason to believe that the deceased may have suffered previous abuse at the hands of her stepfather, and this was not reported. This is the basis for the arrest of the adolescent mother who, in this instance, only reported the incident to the police two days later, “Peters said.

The couple are expected to return to court on December 2.
