JOHANNESBURG – The Democratic Alliance (DA) described Tuesday’s ruling by the Supreme Court of Appeals that enforced the reinstatement of the dissolved Tshwane municipal council as a victory for democracy.

The court ruled against the Gauteng government’s request for an appeal of an earlier decision that overturned its actions.

This was after the dissolution of the council and the appointment of a manager.

The district attorney, who first took the matter to court, said he was ready to start work on the conflicted subway that had been unable to hold council meetings or provide services to its residents in a standoff dating back to last year. .

Acting Head of the Prosecutor’s Office John Steenhuisen told reporters that the Supreme Court’s decision would ensure that the provincial government would not hijack local governance by invoking some sections of the Constitution that empowered it to take over when there was dysfunction.

“Above all, this judgment exposes that the ANC and, in particular, the villain of the article, MEC Maile, was involved in a seizure of power and abused its position and the Constitution to try to carry out this seizure of power by The back door”.

Meanwhile, the African National Congress (ANC) said it was still studying the ruling.

Councilors for the ANC and the Economic Freedom Fighter (EFF) were blamed by the courts for collapsing the council after staging several strikes during meetings when the two sides challenged the legitimacy of the DA-led administration.

The provincial government and the prime minister of Gauteng still have another appeal on the same matter, with a pending judgment in the Constitutional Court.
