JOHANNESBURG – Former Criminal Intelligence Chief Richard Mdluli’s request for permission to appeal both the conviction and sentence for himself and his co-defendant, Mthembeni Mthunzi, was denied.

The Johannesburg High Court sentenced the couple to an effective five years in prison.

The case relates to the 1999 murder of Oupa Ramogibe, who allegedly had an affair with Mdluli’s wife, Tshidi Buthelezi.

Mdluli and Mthunzi were found guilty last July of kidnapping, common battery, assault with intent to cause serious bodily harm and four counts of intimidation.

Mdluli said it would apply to the Supreme Court of Appeals (SCA).

“As I have indicated, I have every right to go to any court. We will petition the Supreme Court of Appeals because we are aware that there are many loopholes that were supposed to be resolved, of which we have been ruled in court, “he said.
