Immediately after losing his offer of bail, Omotoso submitted a request for permission to appeal the decision, which was rejected.
In his view, Judge Phillip Zilwa said that no other court would have reached a different conclusion.
“The two remaining prosecutors [Ntelwa and Jodwana-Blayi] they are equally capable of successfully processing the case, ”said Ngcakani.
On Tuesday, Omotoso, 62, and his two co-defendants, Lusanda Sulani, 37, and Zukiswa Sitho, 29, were expected to pass judgment, and the testimony of two state witnesses was expected to be removed from court records.
In their application, the trio claimed that the evidence of Lerato Msibi, 30, and Andisiwe Dike, 30, amounted to additional charges and should not be admissible.
The result of the application is expected to be heard on Monday after one of the state prosecutors tested positive for Covid-19.
Omotoso, Sulani and Sitho face 63 main charges and 34 alternative charges ranging from rape to human trafficking, sexual assault and organized crime.
Omotoso has been in custody since his arrest in April 2017, while Sulani and Sitho are out on bail of R2,000 each.
