Gauteng Prime Minister David Makhura has welcomed a correction to the Special Court ruling, handed down in the controversial Gauteng Personal Protective Equipment (PPE) tender awarded to Ledla Structural Development and others, which clears his name.

Following the December ruling, which overturned the award of a PPE tender to Ledla Structural Development and three other people, Makhura approached the court to amend the ruling that Kabelo Lehoenya, former Chief Financial Officer of the Department of Health, claimed that he gave the names of the companies that would be designated as PPE service providers.

Makhura submitted an application to the court after seeing that the judge had made a mistake in replacing “the prime minister’s office”, which is said to have around 350 employees, with “the prime minister”.

“Upon receiving the prime minister’s request, I realized that the omission of the word ‘Office of’ before ‘the prime minister’ and ‘the MEC’ in the text of the judgment can be interpreted to mean that the court has determined or decided that it was the prime minister personally or the MEC personally, who provided the names. There was no such decision or finding on the allegations, “Judge Billy Mothle said in his sentencing Monday.

Makhura said he was happy that the statement was corrected “making it clear that there were no allegations against the prime minister’s involvement in irregularities in the acquisition of PPE.”

The remainder of Mothle’s trial in the case, which was heard in December, was unchanged. He had ordered the tender to be canceled and the state confiscated the funds.

The Special Investigation Unit (SIU) previously found that the contracts were irregularly awarded to Ledla Structural Development, which is a “representative” of Royal Bhaca Projects and is owned by the husband of Presidential Spokesperson Khusela Diko, Madzikane ll Thandisizwe Diko.

The Gauteng health department issued the multi-million rand tender for EPP.

Mothle issued its ruling after the SIU filed an urgent request with the court on August 19.
