Cape Town – Nyanga police have warned the public of the crime charges of libel (intentional damage to someone’s dignity) they could face if they continue to circulate a video of a woman being raped, allegedly by two men.

The woman’s brother, known to the Cape Times, believes his sister was drugged before she was raped and the incident recorded.

The woman is believed to have been out when a spike was allegedly added to her drink, as she still doesn’t remember what happened next.

Police spokesman FC van Wyk said two suspects, 26, were arrested Thursday on a rape charge and were expected to appear before Wynberg Magistrates Court once charged.

Nyanga Police Station Commander Vuyisile Ncata said: “We are aware of the video circulating in Crossroads and neighboring communities. I met with the whistleblower on Wednesday who is the victim.

“She came to my office and I helped her ensure that a case was opened. At dawn (yesterday) we managed to track down the suspects who appeared in the video and arrested them. Nyanga’s family violence, child protection and sex crimes detectives are investigating the case. “

Ncata said the issue is not just about rape, but about the crime of injury.

“Suspects could also face multiple charges following threats made to the whistleblower and blackmail.

“We thank the complainant for being brave and coming forward to report the case. The author has already been referred for advice and information.

“I am also grateful to the residents who brought this to my attention, but now I urge people to stop sharing the video on all social platforms.

“This video involves other people and they didn’t get any consent.

“Once we can prove that anyone is circulating the footage, they can also be charged with a crime of injury because it is against the will of the victim.

“They have to stop it and remove it from their phones or wherever they shared it. It is illegal and immoral; this is a serious GVB problem, “said Ncata.

He added that the Nyanga police were doing their best to prioritize gender-based violence and partnered with the advocacy group Ilitha Labantu on Thursday in a caravan to raise awareness.

Separately, rape defendant and former top city official Raphael Martin is expected to appear in court again next month to have his case transferred to a higher court.

Martin appeared in Mitchells Plain Magistrates Court Thursday and is charged with raping a 13-year-old girl.

The spokesman for the National Tax Authority, Eric Ntabazalila, confirmed that the matter was postponed until December 11 for a hearing date.

Meanwhile, the matter against rape defendant and alleged pedophile Nicholas Maré has been postponed to next year for further investigation.

Maré, director of Tariro Model Management on Loop Street, will appear in court again on February 25 and is charged with raping a 14-year-old girl who went to a photo shoot on June 24.

Police arrested Maré after conducting a search and seizure at the modeling agency.

He was charged with rape and sexual assault related to the creation and possession of child pornography and sexual exploitation of children.
