Public protector Busisiwe Mkhwebane.
- Four political parties opposed a motion to initiate an investigation into the fitness of the Public Protector to hold office.
- The House voted 275 in favor, 40 against, and one abstention.
- The EFF said it would challenge the National Assembly’s decision in court.
The EFF will go to court to challenge the National Assembly’s decision to proceed with an investigation into the fitness of Public Protector Busisiwe Mkhwebane to serve.
The House voted 275-40 to go ahead with the process during Tuesday’s vote. There was one abstention.
Before the vote, EFF MP Natasha Ntlangwini said the rules were made specifically to target Mkhwebane, as was the notorious Sobukwe Clause of the apartheid Parliament and that the EFF would go to court if the National Assembly voted to favor of the investigation.
In November, the Western Cape Superior Court dismissed a similar argument from Mkwhebane when he tried to stop the proceedings.
The UDM, Al Jama-ah and the ATM were the other parties that opposed going ahead with the investigation.
The ATM claimed the matter was sub judice. The district attorney, who filed the motion for deportation proceedings, ANC, IFP, FF Plus and NFP supported moving forward with the investigation. Cope abstained from voting.

President Thandi Modise said the vote was to determine whether to proceed with an investigation into Mkhwebane’s fitness for office and would not determine his guilt.
