Not wearing a mask is now a crime in South Africa

President Cyril Ramaphosa has announced that South Africa will move to lockdown level 3 at midnight on Monday, December 28.

He said that all indoor and outdoor gatherings except funerals will be banned for the next 14 days.

The curfew is adjusted from 21:00 to 06:00 and all non-essential establishments such as bars and restaurants must close at 20:00.

The sale of alcohol was also prohibited and the operation of nightclubs and bars that sell alcohol will not be allowed.

As part of the new rules, not wearing a mask is now a crime and people who don’t wear a mask in public can be arrested.

Until now, public building and store owners and managers, employers and public transport operators had a legal responsibility to ensure that everyone entering their premises or vehicles wears a mask.

“But given the grave danger facing our country now, the tight Level 3 regulations will make each individual legally responsible for wearing a mask in public,” Ramaphosa said.

From now on it is mandatory that everyone wears a mask in a public space.

“A person who does not wear a cloth mask that covers the nose and mouth in a public place is committing a crime,” he said.

A person not wearing a mask could be arrested and prosecuted.

In the event of conviction, they will be fined or imprisoned for a period not exceeding six months, or a fine and imprisonment.

“This is a drastic measure, but it is now necessary to ensure compliance with the most basic preventive measures,” Ramaphosa said.
