JOHANNESBURG – Norma Mngoma’s lawyers have argued that she is undergoing ongoing harm and therefore her matter must be addressed urgently.

The wife of former Finance Minister Malusi Gigaba was in Pretoria High Court to challenge the validity of his arrest.

Mngoma was arrested in July and spent one night in police holding cells in Brooklyn for allegedly damaging a car that was in Gigaba’s possession.

Mngoma’s attorneys have turned to Superior Court to have her case heard urgently, citing the Hawks’ conduct in arresting their client and the ongoing trauma she and her children were experiencing.

Attorney Dali Mpofu said: “Once the poisonous element of the Hawks involvement, the question then is why did the Hawks have to get involved in this? So everything else that follows is tainted by that illegality. “

But Dawie Joubert, from the state, said all the points raised by Mpofu are not urgent and can be addressed during a trial or settlement.

“The court should ask itself on what basis the applicant could persuade that this court will not be redressed in due time.”

Mpofu has also argued that the state has withheld six discs where Mngoma’s urgently needed personal data has been stored.
