AfriForum argued in Pretoria High Court on Thursday that the minister made the decision on a national rewrite without proper consultation with the DBE director general (DG) and other educational bodies.

JOHANNESBURG – AfriForum told the Pretoria High Court on Thursday that Basic Education Minister Angie Motshekga had no power in terms of regulations to decide on a national rewrite of two leaked matrix tests.

The lobby group, along with the Democratic Teachers Union of South Africa (Sadtu), are challenging the decision of the Department of Basic Education (DBE).

Motshekga has been accused of failing to present valid reasons why a rewrite was necessary.

AfriForum argued in High Court that the minister made the decision on a national rewrite without properly consulting with the director general (DG) of DBE and other educational bodies.

“There is no indication in all of these documents that the CEO has even considered, much less consulted, and made a decision. The minister made the decision, ”said AfriForum lawyer Quintis Pelser.

Pelser said Motshekga’s decision should be set aside.

“It should be reviewed and put aside,” he said.

Sadtu, meanwhile, agreed with AfriForum, saying Motshekga was also unable to explore other alternatives before making the decision on a national rewrite.
