The executive mayor of the local municipality JB Marks in Klerksdorp, Kgotso Khumalo, and CJ Hendry, a director of the municipality, appeared in Potchefstroom magistrates court on Friday on charges of theft and fraud.
The spokesman for the Northwest National Prosecution Authority, Henry Mamothame, said in a statement that a third defendant is expected to turn himself in to police on Monday.
Khumalo, Hendry and the third man face eight counts of theft and fraud involving city funds. It is alleged that the Northwest University and the Community Development Program paid around R5m into a trust account of an attorney for the use of specific projects by the municipality.
The lawyer was then instructed to make various payments, including a mayoral committee contribution of R208,000 for the funeral of the late MEC of agriculture, Duma Ndleleni, who died in 2018.
However, it was found that R200,000 was allegedly paid directly into the account of one of the defendants. Of this amount, R64,218 was allegedly paid to an institution where a Khumalo relative was a student, according to the statement.
