Malawi court rules Bushiris’ arrest illegal and orders their release

According to local media, Judge Viva Nyimba issued the ruling based solely on the legality of the couple’s arrest in that country and not on their imminent case in South Africa.

JOHANNESBURG – The Lilongwe Magistrates Court in Malawi ruled Thursday that the arrest of Shepherd Bushiri and his wife, Mary, was illegal and ordered the couple to be released unconditionally.

According to local media, the magistrate Viva Nyimba issued the ruling based solely on the legality of the couple’s arrest in that country and not on their imminent case in South Africa.

Days have passed since the couple fled South Africa undetected in violation of strict bail conditions.

They face charges of fraud, corruption and money laundering, but Magistrate Nyimba said the couple’s corruption trial will only be considered once documents for their extradition are processed.
